  • Baitulmal in the Fara'id System: RETHINK AND REVISE

This book will give readers new insight of how the excess estate (Radd) in the net estate is being disposed. How a non-family member, Baitulmal, who has made no contribution to the wellbeing of a deceased during his life time is able to inherit the deceased's net estate. This creates a reduction in the share or a total loss to the deceased's family members or dependants. Is this justice or Shari'ah compliance?

It highlights the different classical views and the contemporary classical views of the 4 madhdhab; Hanafi, Hanbali, Maliki and Shafii. It also elaborates the legislations and it's justifications in some Muslim and non Muslim countries in the matters pertaining to this subject, should Baitulmal receive or not receive the Radd.

It also discusses sections in the AMLA (Administration of Muslim Law Acts) on this subject. This will certainly help readers to understand and appreciate the position adopted by Singapore's constitution pertaining to Muslim law in estate matter.

Finally, the recommendations made in this book will help readers to seek the overdue changes in practicing Muslim law in today's context, especially in Singapore.
