  • Joint Tenancy: The Shariah Perspectives

This book on Joint Tenancy is a continuation of the author's first book on the same subject. The main objective is for the readers to understand what Joint Tenancy is from three different perspectives: MUIS (Islamic Religous Council of Singapore), legal personnel and the writer's own. The book presents information provided by MUIS and legal personnel, and information obtained through the writer's research on wealthlestate planning for Muslims in congruence with Shariah and Civil Law.

The concept of Joint Tenancy is discussed in great detail from the above three different understandings. The book presents the advantages and disadvantages of Joint Tenancy in various situations that Muslims normally encounter. The writer describes how these different views can be harmonised to help Muslims be able to practise the Shariah principle within the Singapore context and apply it to estate matters.

This book also makes recommendations on how and why Joint Tenancy can be institutionalised to meet both the Civil law and Muslim law requirements. This innovative solution in harmonising both the Civil law and Muslim law should be read by taking reference to Maqāşid Al-Shari'ah (Objectives of Shariah) not just Fatwa. One must not analyse Joint Tenancy by taking reference from commonly known mechanisms only, namely the Wasiyyah or the Faraid principles.

The writer hopes that ultimately this book will create changes within the Muslims to accept Joint Tenancy as an innovative means of wealth transfer that is in accordance with the Shariah. As a result, there should not any more widows losing their homes due to the misunderstanding of the Shariah.
