This book highlights the common challenges faced by the legal heirs when a deceased person dies without leaving a proper and comprehensive Will and or wealth/estate transfer deed. The challenges are very complex and in most cases will cause hardship and be very time consuming in disposing the deceased's wealth/estate.

There are two parts in estate disposal, getting the court order and distributing of the wealth/estate based on Muslim Law. Getting the court order is standard practice applicable to both Muslims and non-Muslim estates. The process of getting the court order for an estate with no Will is not an easy task. The challenges are explained in this book.

The distribution based on Muslim Law is another issue that the administrator/s has to grapple with. In my experience, this is normally the toughest process in disposing the deceased's estate. The Fara'id (Muslim Law of Inheritance / Intestate Succession for Muslims) will normally be applied. The application of Fara'id is being simply applied through the Certificate of Inheritance (COI) issued by the Syariah Court. This book shows how enforcement of the COI rarely meets objectives of Fara'id to achieve the Objective of Syariah. The Objective of Syariah is to protect religion, family, wealth, life, intellect and honour. This 2nd edition includes several of MUIS latest Fatwas that were issued after the 1" edition of this book. It touches briefly on the impact of MUIS fatwas.

This book highlights to the reader the importance of leaving the last advice through a comprehensive estate planning on how the wealth/estate is to be purified, disposed and preserved so as to achieve the Objective of Syariah.
